Teravit Creators Grand Prix -Making a Game of the Future Together- Application Rules

Applicants (hereinafter referred to as ‘Applicants’) for the ‘Teravit Creators Grand Prix -Making a Game of the Future Together-‘ (hereinafter referred to as the ‘Contest’) held within the online game Teravit (hereinafter referred to as the ‘Service’) provided by CyberStep, Inc. (hereinafter referred to as the ‘Company’) must read these Contest Rules (hereinafter referred to as the ‘Rules’) and agree to all terms before submitting an entry.

By submitting an entry to this contest, the applicant is deemed to have agreed to all of the terms and conditions of these rules.

Article 1 (Application Conditions)

  1. Entries submitted to the Contest (hereinafter referred to as ‘Submitted Worlds’) must be created by the Applicant and must be owned by the Applicant.
  2. If an entry is created collaboratively by multiple people, the Applicant must act as the representative and submit the entry with the consent of all parties involved. At a later date, the Company may request a written consent form from all creators.
  3. If a minor submits an entry, they must obtain consent from their parent or guardian. By completing the submission, it is assumed that such consent has been obtained. At a later date, the Company may request a written consent form from the parent or guardian.
  4. If the Company determines that an entry or any related actions fall under, or may fall under, any of the following, the entry will be disqualified from judging. Even after an award has been granted, if such circumstances are discovered, the award may be invalidated or revoked, and in such cases, the Company may require the recipient to return any prize money or other awards.
    • Entries that do not comply with these Rules.
    • Entries that interfere with the operation of the Contest.
    • Entries or actions that infringe on the intellectual property, honor, credibility, portrait rights, privacy, or other rights of third parties.
    • Entries that violate public order or morals.
    • Entries for which permission to use has been granted to a third party.
    • Entries already submitted to other contests, or that have previously won awards in other contests.
    • Entries or actions that cause inconvenience, disadvantage, damage, or discomfort to others.
    • Entries or actions that defame others or damage their honor or credibility.
    • Entries deemed by the Company to provide information, advertising, or solicitation for commercial purposes.
    • Entries that violate the Service’s Terms of Use or applicable laws and regulations.
    • Other entries deemed by the Company to be inconsistent with the purpose of the Contest, or malicious/inappropriate.

Article 2 (Handling of Submitted Worlds)

  1. If an Applicant’s Submitted World wins an award, the Applicant agrees to transfer all copyrights of the Submitted World, including the rights specified in Articles 27 and 28 of the Copyright Act, to the Company free of charge.
  2. By submitting an entry to the Contest, Applicants agree to the following and also warrant the following:
    • The Submitted World is an original work created by the Applicant in accordance with these Rules, does not infringe the rights of any third party, and the Applicant holds full and valid rights to the Submitted World.
    • The Submitted World has not been submitted to any other contest, whether published or unpublished.
    • The Applicant agrees in advance that the Company may use the Submitted World for any purpose, including distribution as a standalone game on platforms such as Nintendo Switch™, PlayStation®4/PlayStation®5, both in Japan and abroad. Winning an award does not guarantee distribution on a specific platform.
    • The Applicant agrees in advance that conditions for selling the Submitted World (including, but not limited to, the work’s description, sales method, and pricing) will be determined at the Company’s discretion.
    • The Applicant agrees in advance that the Company and third parties authorized by the Company may modify the Submitted World (including adjustments to game balance, design changes, or corrections from an ethical perspective) for use.
    • The Applicant agrees in advance not to exercise moral rights of authorship with respect to the use of the Submitted World by the Company or third parties authorized by the Company.
  3. If circumstances arise after winning that would disqualify the entry, the copyright transfer described in the previous section will be considered null, and the award may be revoked.

Article 3 (Prizes, etc.)

  1. The Company will award winners with prizes and rewards separately determined (hereinafter referred to as ‘Prizes’).
  2. The details, timing, and method of awarding Prizes will be specified on the Contest detail page or communicated directly to the winners by the Company.
  3. If winners fail to complete the required procedures to receive Prizes (such as providing personal information or bank account details) by the specified deadline after being contacted by the Company, they may be considered to have forfeited their right to receive the Prizes.
  4. The only compensation the Company will pay to Applicants is the Prizes specified in this section. Even if the Company sells or distributes a Submitted World in accordance with Section 2 and generates revenue, the Company has no obligation to pay the Applicant any royalties or other monetary compensation.
  5. If a collaboratively created Submitted World wins an award, the Prizes will be paid in a lump sum to the representative Applicant. The Company is not responsible for any disputes among co-creators regarding the distribution of Prizes.
  6. Taxes, transfer fees, and other costs associated with the Prizes are the responsibility of the winners. The Company may perform necessary procedures such as withholding taxes in accordance with applicable laws.

Article 4 (Obligations of Winners)

  1. Winners agree to cooperate, to the extent possible, with interviews or coverage related to the Contest by the Company and third parties authorized by the Company (including, but not limited to, TV, newspapers, magazines, and websites).

Article 5 (Notes)

  1. Winners will be contacted via the email address registered in this service or on the Creators’ site. If we are unable to reach you, or if you do not respond by the specified deadline, your prize may be forfeited.
  2. The Company holds the final decision making authority regarding judging and results, and Applicants agree not to dispute this. The Company will not respond to individual inquiries about the selection process or results.
  3. Internet connection and communication fees incurred in submitting an entry to the Contest are the responsibility of the Applicant.

Article 6 (Handling of Personal Information)

The Company will appropriately handle personal information obtained from Applicants in relation to the Contest in accordance with the Company’s Privacy Policy. The personal information collected will be used solely for the purposes of operating the Contest, contacting Applicants, awarding Prizes, and other purposes related to the Contest.

Article 7 (Disclaimer)

  1. Applicants participate in the Contest at their own risk and expense.
  2. The Company may change, suspend, or cancel all or part of the Contest without prior notice. If deemed necessary, the Company may also modify these Rules without prior notice to Applicants.
  3. The Company is not responsible for any troubles or damages (direct or indirect) arising from submitting an entry to the Contest or from being unable to submit an entry.
  4. If a dispute arises with a third party regarding a Submitted World, the Applicant shall resolve it at their own expense and responsibility, and the Company assumes no liability.

Article 8 (Exclusion of Anti-Social Forces)

Applicants represent that they are not members of organized crime groups, gangsters, or other antisocial forces, and they warrant that they will not fall under such categories in the future.

Article 9 (Governing Law and Jurisdiction)

These Rules are governed by Japanese law. In the event of a dispute between Applicants and the Company regarding the Contest or these Rules, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.
